Welcome to YenzyPay. These Terms and Conditions ("Terms") govern your use of the YenzyPay mobile application, website, and all related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. Acceptance of Terms

By downloading, installing, registering, or using YenzyPay, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease using our Services and uninstall the application.

These Terms form a legally binding agreement between you ("User", "you") and YenzyPay ("Company", "we", "us", "our").

2. Eligibility

To use YenzyPay, you must:

  • Be at least 18 years of age or the legal age of majority in your jurisdiction
  • Have the legal capacity to enter into a binding contract
  • Not be prohibited from receiving services under applicable laws
  • Reside in a country where YenzyPay operates and its services are permitted
  • Provide accurate, complete, and current personal information during registration

Minors under 18 may not create accounts. If we discover that a minor has registered, we reserve the right to suspend or terminate the account immediately.

3. Account Registration

When creating a YenzyPay account, you agree to:

  • Provide truthful, accurate, and complete registration information
  • Maintain and promptly update your information to keep it accurate
  • Keep your password and PIN strictly confidential
  • Accept full responsibility for all activities under your account
  • Notify us immediately of any unauthorized use at security@yenzypay.com

You may only maintain one personal account. Creating multiple accounts for fraudulent purposes is strictly prohibited and may result in permanent bans and legal action.

We reserve the right to require identity verification (KYC) at any time as required by applicable financial regulations.

4. Services Provided

YenzyPay provides the following digital financial services:

  • Peer-to-Peer Transfers: Send and receive money between YenzyPay users instantly
  • QR Code Payments: Pay merchants and service providers via secure QR codes
  • Moneybox Savings: Create personal savings goals with locked funds
  • Tontine/Group Savings: Organize and manage rotating savings groups digitally
  • Merchant Services: Accept payments as a registered business or merchant
  • Offline Payments: Pre-authorized QR transactions usable without internet
  • Transaction History: Full records of all financial activities

YenzyPay reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice. We do not guarantee uninterrupted availability of all services.

5. Fees & Charges

Our fee structure is transparent:

  • YenzyPay-to-YenzyPay transfers: Free (0 FCFA)
  • External bank withdrawals: Fee disclosed before transaction confirmation
  • Mobile money cashout: Fee disclosed before transaction confirmation
  • Merchant payments: Free for consumers; merchant processing fees apply separately
  • Currency conversion: Exchange rate and conversion fee shown upfront

All applicable fees are clearly displayed before you confirm any transaction. We will never deduct unexpected charges without prior notification. Fee structures may change with 30 days' notice via the app or email.

6. Prohibited Activities

You agree not to use YenzyPay for any of the following:

  • Money laundering, terrorism financing, or any illegal financial activity
  • Fraudulent transactions, scams, or deceptive schemes
  • Purchasing illegal goods, services, or content
  • Unauthorized access to other users' accounts
  • Sending unsolicited communications or spam via our platform
  • Attempting to reverse-engineer, hack, or exploit our systems
  • Creating fake accounts or impersonating other individuals
  • Circumventing our KYC or AML (Anti-Money Laundering) procedures
  • Any activity that violates applicable laws in your jurisdiction

Violations may result in immediate account suspension, fund freezing pending investigation, and reporting to relevant law enforcement and financial authorities.

7. Intellectual Property

All content within YenzyPay — including the app interface, logo, trademarks, code, brand assets, written content, and graphics — is the exclusive intellectual property of YenzyPay.

  • You may not copy, reproduce, distribute, or create derivative works without written permission
  • The YenzyPay name and logo are registered trademarks and may not be used without authorization
  • You grant YenzyPay a non-exclusive license to use any content you voluntarily submit (e.g., feedback, reviews)

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • YenzyPay is not liable for indirect, incidental, or consequential damages
  • We are not responsible for losses resulting from unauthorized account access caused by your failure to safeguard credentials
  • We are not liable for service interruptions caused by third-party infrastructure, telecommunications, or force majeure events
  • Our total liability in any matter shall not exceed the amount of fees you paid in the three months preceding the claim

YenzyPay provides services "as-is" without warranties of any kind, express or implied. We do not warrant that the service will always be error-free or uninterrupted.

9. Termination

By You: You may close your account at any time by contacting support@yenzypay.com. Any remaining balance must be withdrawn before closure. Moneybox locked funds will be released upon account closure.

By Us: We may suspend or terminate your account immediately if we detect: fraud, policy violations, suspicious activity, or regulatory requirements necessitating account closure. We will provide notice where legally permissible.

Upon termination, your right to use the Services ceases. Sections covering Intellectual Property, Liability, and Governing Law survive termination.

10. Governing Law

These Terms are governed by the laws of Côte d'Ivoire and applicable WAEMU (West African Economic and Monetary Union) financial regulations. Any disputes arising from these Terms shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts of Abidjan, Côte d'Ivoire.

Users outside Côte d'Ivoire agree to comply with local laws in addition to these Terms.

11. Changes to Terms

We may update these Terms at any time. When we make material changes, we will:

  • Notify you via push notification and email at least 14 days before changes take effect
  • Display a prominent notice within the app
  • Update the "Last Updated" date at the top of this page

Continued use of YenzyPay after changes take effect constitutes acceptance of the revised Terms.
